1. Independent Decanting Status Declaration

TopNote operates as a completely independent boutique decanting facility. We purchase authentic factory flacons of high-end designer and Arabian perfumes through verified distributors, and manually partition the original formulations into smaller custom atomizers under clean laboratory controls. TopNote holds no license, commercial franchise, or formal joint-venture contract with the original copyright design houses or fragrance creators. All underlying brand name identifiers belong strictly to their registered trademark owners under the Trademarks Act (Cap 506).

2. Valuation, Pricing and Financial Settlements

All digital metrics are displayed in Kenyan Shillings (KES). Items are subject to pricing fluctuations based on wholesale cost shifts or global exchange movements without advance announcement. Final costs at checkout explicitly incorporate logistical distributions and statutory values outlined under the Value Added Tax (VAT) Act. Full transaction authorization must clear through our integrated payment systems (such as M-Pesa or registered card gateways) before any custom item production or shipment handoff occurs.

3. Logistical Dispatches and Passing of Risk

In alignment with the Sale of Goods Act (Cap 31), the physical risk of loss, leaking, or thermal degradation transfers completely to the consumer upon successful handoff to the independent regional shipping firm or courier provider. Indicated delivery windows serve as operational estimates; TopNote is exempt from secondary or consequential damages arising from delays caused by third-party transport or regional courier operations.

4. Cyber Security Limitations and Jurisdiction

Any attempt to manipulate payment paths, execute fraudulent financial reversals, or disrupt the server architecture will result in immediate profile suspension and formal referral to legal authorities under the Computer Misuse and Cybercrimes Act, 2018. All interactions on this platform are governed by the laws of the Republic of Kenya. Any irresolvable commercial disputes will be handled exclusively through standard arbitration channels or courts situated in Nairobi, Kenya.
